These Terms of Use (“Terms”) govern your access to and use of harborflow.net and related public pages (the “Site”). The Site is operated by Harbor Company Brands, LLC under the HarborFlow name (“HarborFlow,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.
HarborFlow is currently a forthcoming service. The Site is informational and lets you request early access. Nothing on the Site constitutes an offer or binding commitment to provide any product or service. These Terms do not govern any future paid, logged-in, or customer product, which will be subject to separate terms if and when it becomes available.
Early access
Submitting an early-access request does not create an account, customer relationship, partnership, confidential relationship, or obligation by HarborFlow to provide access.
Product features, availability, coverage areas, timing, and pricing may change at any time. We may accept, reject, prioritize, or discontinue early-access requests at our discretion.
Permitted use
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- interfere with or disrupt the Site;
- attempt to gain unauthorized access to any system, account, data, or network;
- probe, scan, or test the vulnerability of the Site except with our prior written permission;
- submit malicious code, spam, misleading information, or unlawful content;
- scrape, copy, or use Site content in a way that violates these Terms or applicable law; or
- impersonate any person or misrepresent your affiliation with any person or organization.
Intellectual property
The Site, including its text, design, graphics, logos, names, and other content, is owned by HarborFlow or its licensors and is protected by intellectual property and other laws.
You may view the Site for your own informational or evaluation purposes. You may not copy, modify, distribute, sell, or create derivative works from the Site or its content without our prior written permission.
Feedback
If you send us ideas, suggestions, comments, or other feedback, you agree that we may use them without restriction or obligation to you. Do not send confidential information through the Site or by email unless we have separately agreed in writing to receive it confidentially.
Third-party services and links
The Site may reference or link to third-party websites, services, or resources. We are not responsible for third-party content, practices, or services.
No warranty
The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, HarborFlow disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Site will be uninterrupted, secure, error-free, or that Site content will be accurate, complete, or current. Site content is provided for general informational purposes only and is not legal, financial, professional, or operational advice.
Limitation of liability
To the fullest extent permitted by law, HarborFlow will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of the Site.
To the fullest extent permitted by law, HarborFlow’s total liability for any claim arising out of or related to the Site or these Terms will not exceed $100.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
Indemnity
You agree to be responsible for claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys’ fees, arising from your misuse of the Site, violation of these Terms, or violation of applicable law.
Changes to the Site or Terms
We may update the Site or these Terms from time to time. The “Last updated” date above indicates when this version was last revised. Your continued use of the Site after changes are posted means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Any dispute arising out of or related to the Site or these Terms will be handled in the state or federal courts located in Texas, unless applicable law requires otherwise.
